Terms of service
These Terms of Use (hereinafter referred to as the "Terms") set forth the terms of use of the online shop (hereinafter referred to as the "Service") provided on this website by Takarayama Brewing Co., Ltd. (hereinafter referred to as the "Company") . Registered users (hereinafter referred to as the "User") must use the Service in accordance with these Terms.
Article 1 (Application)
These Terms apply to all relationships between Users and the Company regarding the use of the Service.
In addition to these Terms, the Company may establish various rules for use, etc. (hereinafter referred to as the "Individual Provisions") regarding the Service. These Individual Provisions, regardless of their name, constitute a part of these Terms.
In the event that the provisions of these Terms conflict with the provisions of the Individual Provisions set forth in the preceding paragraph, the provisions of the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
Registration for the Service is considered complete when an applicant agrees to these Terms, applies for user registration in the manner specified by the Company, and the Company notifies the applicant of its approval.
We may deny a user registration application if we determine that the user has committed any of the following offenses, and we are under no obligation to disclose the reasons for such denial.
If a false statement is submitted when applying for user registration.
If the application is from a person who has previously violated these Terms of Use.
If we otherwise determine that user registration is inappropriate.
Article 3 (Management of User ID and Password)
Users shall manage their user ID and password for the Service at their own risk.
Under no circumstances may users transfer, lend, or share their user ID and password with third parties. If a user logs in using a user ID and password combination that matches their registered information, we will consider that use to be by the user who registered that user ID.
We shall not be liable for any damages arising from the use of a user ID or password by a third party, except in cases of willful misconduct or gross negligence on our part.
Article 4 (Sales Contract)
A sales contract for the Service is established when a user submits a purchase application to us and we notify them that we have accepted the application. Ownership of the product will be transferred to the user when the Company delivers the product to the delivery company.
The Company may terminate the sales contract set forth in the preceding paragraph without prior notice to the user if the user falls under any of the following circumstances:
If the user violates these Terms and Conditions;
If delivery of the product cannot be completed due to an unknown delivery address or the user's prolonged absence;
If the Company otherwise determines that the trust between the Company and the user has been damaged.
Payment methods, delivery methods, purchase order cancellation methods, and return methods for this service will be determined separately by the Company.
Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights to product photos and other content (hereinafter referred to as "Content") provided through this service belong to the legitimate rights holders, such as the Company and content providers. Users may not reproduce, reprint, modify, or otherwise use such Content without permission.
Article 6 (Prohibited Acts)
Users shall not engage in the following acts when using this service.
Acts that violate laws and regulations or public order and morals
Acts related to criminal activities
Acts that infringe copyrights, trademarks, or other intellectual property rights contained in this service
Acts that destroy or interfere with the functioning of our servers or network
Acts that commercially use information obtained through this service
Acts that may interfere with the operation of our services
Acts of unauthorized access or attempted unauthorized access
Acts of collecting or storing personal information about other users
Acts of impersonating other users
Acts that directly or indirectly provide benefits to anti-social forces in connection with our services
Other acts that our company deems inappropriate
Article 7 (Suspension of Provision of this Service, etc.)
Our company reserves the right to suspend or interrupt the provision of all or part of this service without prior notice to users if we determine that any of the following circumstances exist.
When maintenance, inspection, or updates are performed on the computer system related to the Service.

Article 8 (Restrictions on Use and Cancellation of Registration)
The Company may, without prior notice, restrict the User's use of all or part of the Service or cancel the User's registration if any of the following circumstances apply:
When a User violates any provision of these Terms of Use.
When false information is discovered in the User's registration.
When the credit card registered by the User as a payment method is suspended.
When the User defaults on payment obligations, such as fees.
When the User does not respond to our communications for a certain period of time.
When the User has not used the Service for a certain period of time since the last use.
When the Company otherwise determines that use of the Service is inappropriate.
The Company shall not be liable for any damages suffered by the User as a result of actions taken by the Company pursuant to this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service by completing the designated withdrawal procedure.
Article 10 (Disclaimer of Warranties and Disclaimers)
We do not guarantee that the Service is free from actual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors, bugs, or infringement of rights).
We shall not be liable for any damages incurred by Users as a result of the Service. However, if the agreement between us and Users regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act, this disclaimer shall not apply. Article 11 (Changes to Service Content, etc.)
We reserve the right to change the content of the Service or discontinue its provision without notice to the User, and shall not be liable for any damages incurred by the User as a result.
Article 12 (Changes to Terms of Use)
We reserve the right to change these Terms at any time without notice to the User if we deem it necessary. Furthermore, if a User begins using the Service after these Terms have been changed, the User will be deemed to have agreed to the changed Terms.
Article 13 (Handling of Personal Information)
We will handle personal information obtained through the use of the Service appropriately in accordance with our Privacy Policy.
Article 14 (Notifications or Contact)
Notifications or contact between the User and the Company will be made in accordance with the methods specified by the Company. Unless the User notifies us of a change in accordance with a method separately specified by the Company, the Company will consider the currently registered contact information to be valid and will notify or contact the User via that contact, and such notification or contact will be deemed to have reached the User at the time of sending.
Article 15 (Prohibition of Assignment of Rights and Obligations)
Users may not assign or pledge their status under the Service Agreement or their rights or obligations under these Terms to a third party without our prior written consent.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. The application of the United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Service.
In the event of a dispute regarding this Service, the court with jurisdiction over our head office location shall be the exclusive court of jurisdiction.
